personality, fears, or unfamiliarity with the legal process,
may need some form of preparation prior to trial or deposition.
Magnus' seasoned professionals have the expertise to meet
a wide array of witness needs, from didactic orientation and
education programs to intensive individual sessions.
Witness Assessment Research

The primary methodology
of Witness Assessment Research involves a research session
structured to focus entirely on witness testimony. This
process involves a neutral presentation of facts in
front of a panel of mock jurors, followed by live or
videotaped testimony by parties, and/or fact or expert
witnesses, to evaluate the witnesses. When possible,
mock direct and cross examinations are employed to simulate
the pressure of the courtroom. Mock jurors provide written
feedback on each witness and to engage in a discussion
about relevant witness issues. This methodology may
be used to evaluate any number of witnesses in a given
case.
A more simplified approach
to Witness Assessment Research involves adding a mock
direct and cross examination, or other testimony, as
an additional part of an ongoing research session, such
as Case Strength Evaluation Research.

Witness Preparation Consultation
| Witness Preparation Consultation
is provided by Magnus to enhance the presentation of the
fact or expert witness. The objective is to enhance the
presentation style, communication ability, demeanor, and
comfort level of the witness, rather than address the
content of the testimony. One of Magnus' Litigation Consultants
will review case materials to develop an understanding
of the case to assess the witness' involvement and consult
with the litigator to determine his or her impressions
of the witness. The Litigation Consultant, who is a clinical
psychologist or communication specialist, will meet with
the witness and provide feedback and offer suggestions
to the witness on how to become more effective in depositions
or at trial. |

Witness Seminars
 |
Witness Seminars are provided as educational
programs to individuals who may be called upon to testify
as fact or expert witnesses. The seminar may be structured
around a specific case, or may be presented more generally.
Witness Seminars provide a general orientation to courtroom
procedures and etiquette, demonstration of direct and
cross examinations, and tips about body language, facial
gestures, voice tone, breathing, and dressing for litigation
success. The goal for Witness Seminars is to provide a
thorough orientation to the trial process for those who
are involved. |
Witness Evaluation Feedback
| Witness Evaluation Feedback does not
involve one on one work with the witness. It is utilized
when the attorney has conducted a witness preparation
session on his or her own, but desires additional input
into working with the witness. One of Magnus' Litigation
Consultants reviews either videotaped testimony or other
materials to provide feedback to the client attorney to
enable the attorney to better prepare his or her witness. |
