Impact of Terrorist Attacks on Jury Selection
Since the September 11 terrorist attacks on America, many litigators have asked us about our views on the impact of the attacks on jury selection. Based on our experience in selecting jurors since the attacks, we have learned that careful consideration needs to be given to jurors, reactions to the issues currently facing our country. Many jurors have indicated that all civil cases are trivial compared to the loss of lives due to the attack. Few jurors, however, have said they could not be fair to the parties because their cases happened to be on trial at this time. In cases involving a party of Middle Eastern background, a Supplemental Juror Questionnaire is recommended to allow jurors to express their honest, and sometimes prejudicial, attitudes about Middle Easterners.
