Five "MUSTS" When Choosing a
Jury Consultant
The right jury consultant can provide a wealth of resources
and is an important addition to any trial team, perhaps making
the difference between winning and losing. There are several
factors the litigator should be considered when retaining
a jury consultant.
Qualifications: Qualified jury consultants
possess doctoral degrees from accredited universities in the
fields of psychology, sociology, other behavioral sciences,
or marketing research who have solid research experience in
the area of psychology and law.
Research Philosophy: Conscientious
consultants carefully plan and execute research projects,
ensuring the research is as bias free as possible. Proper
research includes selecting mock jurors in the same way real
jurors are chosen in the venue.
Research Services: Your consultant
should conduct a thorough needs assessment of your case and
design the research program in a way that provides definitive
answers.
Consulting Approach: The consultant
should "consult" with the litigator, providing a
complementary, objective, and different perspective. In no
way should the consultant assume the role of advocate, a role
reserved for the litigator.
Ethics: Ethical considerations include
revealing specific research methodologies; accuracy in reporting
research results; and proper treatment of participants, staff,
and clients.
Work closely with your jury consultant
to learn everything you need to enhance your representation
of your client.
