The Magnus Approach

Needs Assessments are conducted by Magnus partners on each and every case Magnus discusses with clients. In this way, Magnus can assess the litigator's concerns and the critical case issues.

Proposals are prepared based on discussions with the litigator and with consideration of all issues, facts, and other constraints. Proposals are a starting point for discussion of precise research design. Magnus is willing to modify proposals to accommodate clients' input concerning changes in case facts, changes in parties, budgetary concerns, or trial schedule. Modifications may include expanding or reducing the amount of research, however, Magnus will not make modifications that compromise the ultimate integrity of the research process.

Research Design and methodological choices are crucial to the efficacy of the research. Magnus' research experts design programs of research to address concerns presented by the litigators. Questions about research design should be raised during initial discussions with Magnus' consultants to ensure the most appropriate methodologies are employed for your case. Magnus' methodological recommendations are a product of extensive training and many years of experience. It should be noted that one of the keys to successful research is a realistic population sample to study. Magnus carefully recruits eligible respondents who reflect the composition of the fact finders in the trial venue.

Timing of Magnus' involvement is crucial. The maximum benefit of utilizing Magnus' services in case preparation is achieved by early inclusion of Magnus as part of the trial team. Magnus is available to consult throughout the litigation process. Magnus' consultants may be retained for "brainstorming", or case "acceptance testing". On complex, significant, or precedent setting cases, Magnus' analyses are invaluable in making the discovery process efficient and effective. Consider the value of knowing the strength of the case prior to mediation to maximize your negotiating position. Magnus provides the means for evaluating the options that exist in making or accepting a settlement offer. Include Magnus on your team early in the litigation process!

Reports are the culmination of all research efforts. Reports are formatted according to the type of research conducted; the contents of the report vary depending on methodology, case complexity, stage of litigation, and unique case factors. All reports are written on a case specific basis by, or under the direction of, Magnus' Director of Research.

The Magnus Approach involves the efforts of its skilled Research Team. The consultant-client relationship is also, by nature, a Team relationship. It is Magnus' goal to become an integral member of the Trial Team to enable the attorney to do all that is possible to serve the interest of his or her client.
